Transfers of Equipment

In general, eligible services and equipment components of eligible services purchased with E-rate discounts cannot be transferred, with or without consideration of money or any other thing of value. 47 C.F.R. § 54.513.

In the Third Report and Order (FCC 03-323, released December 23, 2003), the FCC established two specific conditions under which equipment could be transferred:

Transfers after three years. No equipment can be transferred for a period of up to three years after purchase. Three years or more after the purchase of such equipment, recipients may freely transfer equipment to other eligible entities. However, such transfers must not be in consideration of money or anything else of value. Transfers from a closed facility. A recipient may transfer equipment purchased with E-rate discounts to other eligible entities if the particular location where the equipment was originally installed is temporarily or permanently closed. It is not necessary for the transferring and receiving entities to have comparable discount levels, as long as each is eligible under the schools and libraries program. The transferring entity must notify SLD of the transfer, and both the transferring and receiving entities must maintain detailed records for a period of five years after the transfer. These records must document the transfer and the reason for the transfer. Moreover, all recipients of support for internal connections must maintain asset and inventory records for a period of five years sufficient to verify the actual location of such equipment. However, such transfers must not be in consideration of money or anything else of value.

Notifying SLD of equipment transfers. To notify SLD of a transfer of equipment, write a letter to SLD that contains the following information:

Projected or actual date of transfer

If the transfer is temporary, the projected date that the equipment will be returned to the transferring entity.

The letter may be sent by regular mail, fax, or e-mail.
